Privacy Policy

The terms defined in our Legal Notice (such as “User”, “Client”, etc.) retain the same meaning throughout this Privacy Policy.

1. Personal data management.

The Client is informed of the regulations governing marketing communications, the Law of 21 June 2014 on confidence in the digital economy, the Data Protection Act of 6 August 2004, as well as the General Data Protection Regulation (GDPR: No. 2016-679).

1.1 Data controllers responsible for the collection of personal data

For Personal Data collected as part of the creation of the User’s personal account and their browsing of the Site, the data controller responsible for processing the Personal Data is: WeLOOP. https://www.weloop.org, represented by Naeem ADIBI, its legal representative.

As the data controller responsible for the data it collects, https://www.weloop.org undertakes to comply with the applicable legal framework. In particular, it is the Client’s responsibility to determine the purposes for which their data is processed, to provide their prospective and existing clients with comprehensive information on the processing of their personal data when obtaining their consent, and to maintain an accurate record of processing activities. Whenever https://www.weloop.org processes Personal Data, https://www.weloop.org takes all reasonable measures to ensure the accuracy and relevance of the Personal Data in relation to the purposes for which https://www.weloop.org processes it.

1.2 Purpose of the data collected

https://www.weloop.org/ may process all or part of the following data:

  • to enable browsing of the Site and the management and tracking of services ordered by the User: connection and Site usage data, billing information, order history, etc.
  • to process requests for quotes and respond to requests for information: surname, first name, company, email address, telephone number, as well as any information provided in the contact or quote request form;
  • to prevent and combat computer fraud (spamming, hacking, etc.): computer equipment used for browsing, IP address, password (hashed)
  • to improve browsing on the Site: connection and usage data
  • to conduct optional satisfaction surveys on https://www.weloop.org: email address
  • to conduct communication campaigns (SMS, email): telephone number, email address

https://www.weloop.org does not sell your personal data, which is therefore used solely where necessary or for statistical and analytical purposes.

Retention period: The data collected via the Site is retained for a maximum period of 3 years from the date of the User’s last contact.

1.3 Right of access, rectification and objection

In accordance with the applicable European regulations, Users of https://www.weloop.org have the following rights:

  • the right of access (Article 15 GDPR) and rectification (Article 16 GDPR), updating and completion of Users’ data; the right to restrict or erase Users’ personal data (Article 17 GDPR) where such data is inaccurate, incomplete, ambiguous, outdated, or where its collection, use, disclosure or retention is prohibited
  • the right to withdraw consent at any time (Article 13(2)(c) GDPR)
  • the right to restrict the processing of Users’ data (Article 18 GDPR)
  • the right to object to the processing of Users’ data (Article 21 GDPR)
  • the right to data portability for the data provided by Users, where such data is subject to automated processing based on their consent or on a contract (Article 20 GDPR)
  • the right to determine what happens to Users’ data after their death and to choose to whom https://www.weloop.org should disclose (or not disclose) their data to a third party whom they have previously designated

As soon as https://www.weloop.org becomes aware of the death of a User and in the absence of any instructions from them, https://www.weloop.org undertakes to delete their data, unless its retention proves necessary for evidential purposes or to comply with a legal obligation.

If the User wishes to know how https://www.weloop.org uses their Personal Data, requests that it be rectified, or objects to its processing, the User may contact https://www.weloop.org in writing at the following address: WeLOOP – DPO, WeLOOP

In this case, the User must specify the Personal Data that they would like https://www.weloop.org to correct, update or delete, and must clearly identify themselves by providing a copy of an identity document (identity card or passport).

Requests for the deletion of Personal Data will be subject to the obligations imposed on https://www.weloop.org by law, particularly with regard to the retention or archiving of documents. Finally, Users of https://www.weloop.org may lodge a complaint with the supervisory authorities, in particular with the CNIL (https://www.cnil.fr/fr/plaintes).

1.4 Non-disclosure of Personal Data

https://www.weloop.org, as the data controller, undertakes not to process, host or transfer the Information collected from its Clients to a country outside the European Union or not recognised as providing an adequate level of protection by the European Commission, without informing the Client in advance. However, https://www.weloop.org remains free to appoint technical and commercial data processors, provided that they offer sufficient guarantees to meet the requirements of the General Data Protection Regulation (GDPR: No. 2016/679).

https://www.weloop.org undertakes to take all necessary precautions to protect the security of the Information and, in particular, to ensure that it is not disclosed to unauthorised persons. However, if an incident affecting the integrity or confidentiality of the Client’s Information comes to the attention of https://www.weloop.org, it shall inform the Client as soon as possible and communicate the corrective measures taken. Furthermore, https://www.weloop.org does not collect any “sensitive data”.

The User’s Personal Data may be processed by subsidiaries of https://www.weloop.org and by data processors (service providers), solely for the purposes set out in this Privacy Policy.

2. Incident notification

Regardless of the efforts made, no method of transmitting data over the Internet or electronic storage is completely secure. We therefore cannot guarantee absolute security. If we become aware of a security breach, we will notify the affected Users so that they can take appropriate measures. Our incident notification procedures take into account our legal obligations, whether at national or European level. We undertake to keep our Clients fully informed of any matters relating to the security of their accounts and to provide them with all the information necessary to help them comply with their own regulatory reporting obligations.

No personal information relating to Users of the Site https://www.weloop.org is published without their knowledge, exchanged, transferred, disclosed or sold in any form to third parties. The only exception would be in the event of the acquisition of https://www.weloop.org and its rights, in which case such information may be transferred to the prospective purchaser, who would in turn be bound by the same obligations regarding the retention and modification of data in relation to Users of the Site https://www.weloop.org.

Security

To ensure the security and confidentiality of Personal Data and Personal Health Data, https://www.weloop.org uses networks protected by standard security measures such as firewalls, pseudonymisation, encryption and password protection.

When processing Personal Data, https://www.weloop.org takes all reasonable measures to protect it against loss, misuse, unauthorised access, disclosure, alteration or destruction.

3. Hyperlinks, “cookies” and web beacons (“tags”)

The Site https://www.weloop.org contains a number of hyperlinks to other websites, which have been established with the authorisation of https://www.weloop.org. However, https://www.weloop.org is not in a position to verify the content of the websites visited via these links and therefore accepts no liability in this regard. Unless you choose to disable cookies, you agree that the Site may use them. You may disable these cookies at any time and free of charge using the options provided for this purpose and described below. Please note that doing so may reduce or prevent access to all or part of the Services offered by the Site.

3.1. « COOKIES »

A “cookie” is a small information file sent to the User’s browser and stored on the User’s device (e.g. computer, smartphone) (hereinafter referred to as “Cookies”). This file contains information such as the User’s domain name, the User’s Internet service provider, the User’s operating system, and the date and time of access. Cookies cannot in any way damage the User’s device.

https://www.weloop.org may process information relating to the User’s visits to the Site, such as the pages viewed and searches carried out. This information enables https://www.weloop.org to improve the content of the Site and the User’s browsing experience.

As Cookies facilitate browsing and/or the provision of the Services offered by the Site, the User may configure their browser to decide whether or not to accept them, so that Cookies are stored on their device or, conversely, rejected, either systematically or depending on their issuer. The User may also configure their browser so that they are prompted to accept or reject Cookies each time, before a Cookie is stored on their device. https://www.weloop.org informs the User that, in this case, some features of their browser may not be fully available.

If the User refuses the storage of Cookies on their device or browser, or deletes those already stored, the User is informed that their browsing experience and use of the Site may be limited. This may also occur when https://www.weloop.org or one of its service providers is unable, for technical compatibility purposes, to recognise the type of browser used by the device, the language and display settings, or the country from which the device appears to be connected to the Internet.

Where applicable, https://www.weloop.org accepts no liability for any consequences arising from the degraded operation of the Site or any Services that may be offered by https://www.weloop.org resulting from (i) the User’s refusal of Cookies, or (ii) the inability of https://www.weloop.org to store or access the Cookies necessary for the Site to function due to the User’s choices. With regard to managing Cookies and the User’s preferences, each browser has different configuration settings. These are described in the browser’s help menu, which explains how the User can change their Cookie preferences.

At any time, the User may choose to express and change their preferences regarding Cookies. https://www.weloop.org may also use the services of external providers to assist it in collecting and processing the information described in this section.

Finally, by clicking on the dedicated social media icons for Twitter, Facebook, LinkedIn and Google Plus displayed on the Site of https://www.weloop.org or in its mobile application, and if the User has consented to the use of Cookies by continuing to browse the Site or mobile application of https://www.weloop.org, Twitter, Facebook, LinkedIn and Google Plus may also place Cookies on the User’s devices (computer, tablet or mobile phone).

These types of Cookies are only placed on the User’s devices with their consent, given by continuing to browse the Site or mobile application of https://www.weloop.org. However, the User may withdraw their consent to https://www.weloop.org placing these types of Cookies at any time.

3.2. Web beacons (“tags”)

https://www.weloop.org may occasionally use web beacons (also known as “tags”, action tags, one-pixel GIFs, transparent GIFs, invisible GIFs or single-pixel GIFs) and deploy them through a web analytics partner, which may be located in another country and may therefore store the corresponding information, including the User’s IP address, there.

These web beacons are placed both in online advertisements that enable Internet users to access the Site and on the various pages of the Site.

This technology enables https://www.weloop.org to assess visitors’ responses to the Site and the effectiveness of its activities (for example, the number of times a page is opened and the information viewed), as well as the User’s use of the Site.

The external service provider may collect information about visitors to the Site and other websites through these web beacons, compile reports on Site activity for https://www.weloop.org, and provide other services relating to the use of the Site and the Internet.

4. Applicable law and jurisdiction

Any dispute arising in connection with the use of the Site https://www.weloop.org shall be governed by French law. Except where otherwise provided by law, exclusive jurisdiction is hereby conferred on the competent courts of Lille.
